Terms of Service

These Terms of Service ("Terms") govern your access to and use of BrainBuzz and any related websites, applications, or services we provide (collectively, the "Service"). By creating an account, accessing the Service, or using the Service on behalf of a child, classroom, or school, you agree to these Terms.

1. Who May Use the Service

BrainBuzz is built for parents, teachers, schools, and students using the Service for educational purposes. If you create or manage a student account, you represent that you have the authority to do so and that any required parental or school consent has been obtained.

2. Accounts and Security

You are responsible for the information you provide, keeping your login credentials secure, and all activity that happens through your account. You agree to provide accurate information and keep it up to date.

3. Educational Use

BrainBuzz is intended to support learning, classroom management, and student practice. You may not use the Service for unlawful, harmful, or disruptive purposes, or in a way that interferes with the educational experience of others.

4. AI-Generated Content

Some parts of the Service may use AI tools to generate puzzles, practice activities, hints, or other educational materials. AI output is provided to help you create or manage learning materials, but it can contain mistakes, omissions, or content that needs review.

You are responsible for reviewing AI-generated content before using it with students. Do not rely on AI output as the sole source for facts, grading, or instructional decisions.

Tutor Plus may use the current BrainBuzz page, an exercise, typed work, or an image or whiteboard the user chooses to share to provide a more relevant answer. Optional web search results can be incomplete, outdated, or inaccurate, even when citations are shown. Account holders are responsible for supervising student use and deciding whether web search is available.

5. Subscriptions and Billing

Some parts of the Service may require a paid subscription. If you purchase a subscription, billing is handled through our payment provider. Unless we say otherwise at the time of purchase, subscriptions may renew automatically until cancelled. Taxes may apply.

To the fullest extent permitted by applicable law, all subscription fees and other charges are non-refundable. We do not provide refunds or credits for partial billing periods, unused time, or features not used during an active subscription period, except where required by law or where we expressly state otherwise in writing.

You may cancel a subscription at any time. If you cancel, your access will continue until the end of the then-current billing cycle, and your subscription will not renew after that cycle ends.

Tutor Plus is an optional $15-per-month add-on and includes a monthly allocation of usage credits shared by the parent account and its students. Different requests may use different credit amounts; requests that include images or web search use more credits. Credits reset at the start of each Tutor Plus billing period, do not roll over, have no cash value, and cannot be transferred. We may enforce request, tool, output, concurrency, and cost limits to protect the Service and keep the plan sustainable. Current usage and the applicable credit charges are shown in the Service.

6. User Content

You may submit content such as assignment text, student names, clue words, responses, classroom information, and other educational material. You remain responsible for any content you submit and you give us the rights necessary to host, process, display, and transmit that content so we can operate the Service.

You agree not to upload content that is unlawful, abusive, infringing, or that violates the rights of others.

7. Student Data and School Use

When a parent, teacher, or school uses BrainBuzz for student learning, the account holder is responsible for providing the Service only to authorized students. We may process student data as needed to provide the Service, maintain accounts, track progress, and deliver educational features.

If a school uses BrainBuzz, the school represents that it has the authority to provide any necessary consent or authorization for student use. If a parent uses BrainBuzz for a child, the parent represents that they are authorized to create and manage that child’s account.

8. Intellectual Property

The Service, including our software, design, branding, and content we provide, is owned by BrainBuzz or its licensors and is protected by intellectual property laws. Except for the limited right to use the Service under these Terms, no rights are granted to you.

9. Acceptable Use

  • Reverse engineer, scrape, or attempt to bypass the Service's security or access controls.
  • Use the Service to send spam, malware, or other harmful code.
  • Interfere with or overload the Service.
  • Misrepresent your identity or the identity of a student, parent, teacher, or school.
  • Use the Service in any way that violates applicable law.
  • Use the Service to cheat, plagiarize, or submit work in a way that violates a school’s academic integrity rules.

10. Third-Party Services

The Service may rely on third-party providers for hosting, payments, email, analytics, or other features. Those providers are governed by their own terms and policies. We are not responsible for outages, changes, or actions outside our control.

11. Suspension and Termination

We may suspend or terminate access to the Service if we believe you have violated these Terms, if we need to protect the Service or other users, or if we discontinue the Service. You may stop using the Service at any time.

12. Disclaimers

The Service is provided on an "as is" and "as available" basis. We do not promise that the Service will always be uninterrupted, error-free, or suitable for every purpose. Educational outcomes depend on many factors outside our control.

13. Limitation of Liability

To the fullest extent permitted by law, BrainBuzz will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will post the updated version on the Service and update the "Last Updated" date.
